Terms and Conditions for PrisUm Lab Online Learning Platform

These Terms and Conditions ("Terms") govern your use of the PrisUm Lab online learning platform (the "Platform"), owned and operated by PrisUm Lab ("we," "us," or "our"). By accessing or using the Platform, you ("you" or "User") agree to be bound by these Terms. This is a small list and we reserve the right to expand and introduce terms that may not be written here on case by case basis to be fair to everyone, platform and the company. If you do not agree with these Terms, please do not use the Platform.

1. Account Creation and Use:

You must be at least 18 years old to create an account. If you are younger than 18, either a parent or guardian can create an account for you to learn a skill.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You agree to provide accurate and complete information during registration and to update it.
We reserve the right to suspend or terminate your account for unauthorized access or breach of these Terms.

2. Course Enrollment and Access:

Enrollment grants a limited, non-exclusive, non-transferable license to access course content for the duration specified.
Course fees are non-refundable except as stated in our Refund Policy (Section 10).
We may modify, suspend, or discontinue any course with or without prior notice.
Lifetime Access (If Applicable): If a course offers "lifetime access," this means access for as long as PrisUm Lab continues to offer the course in its current format. We reserve the right to discontinue courses or update course content, which may render previous versions inaccessible.

3. Instructor-Led Sessions:

Sessions are conducted at scheduled times. We may reschedule or cancel sessions due to unforeseen circumstances.
Respectful conduct is expected. Disruptive behavior may result in removal and account suspension.
Recording of sessions by Users is prohibited without prior written consent from both the instructor and PrisUm Lab.

4. Instructor Relationship:

Instructor Rights: Instructors retain ownership of their course content. They grant PrisUm Lab a non-exclusive, worldwide license to host, market, and distribute their courses on the Platform. Instructors may use their content elsewhere, unless otherwise agreed upon in a separate agreement.
Platform's Role: PrisUm Lab provides a platform for instructors to offer their courses. We may provide marketing support but do not guarantee any specific level of course sales. We reserve the right to review course content for quality and compliance with these Terms.
Instructor Liability: Instructors are responsible for ensuring their course content does not infringe on any third-party rights. PrisUm Lab is not liable for instructor content infringement.
Instructors are paid a service fees after deducting all the applicable fees.

5. Intellectual Property:

All Platform content (excluding instructor-provided content) is owned by PrisUm Lab or its licensors and is protected by copyright and other intellectual property laws.
You may not record, copy, reproduce, distribute, modify, display, perform, publish, or create derivative works without our written consent.
You retain ownership of content you submit (e.g., forum posts), but grant PrisUm Lab a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute it in connection with the Platform.

6. User Conduct:

You agree not to use the Platform for any unlawful or unauthorized purpose.
You agree not to engage in any activity that could damage, disable, overburden, or impair the Platform.
You agree not to upload or transmit any viruses, malware, or other harmful code.
You agree not to engage in harassment, discrimination, or hate speech.

7. Content Moderation:

We reserve the right to monitor and moderate all content on the Platform.
We may remove any content that violates these Terms or is otherwise deemed inappropriate.
Users may report content that they believe violates these Terms.

8. Dispute Resolution:

If a dispute arises between you and an instructor, we encourage you to first attempt to resolve it directly with the instructor.
If you cannot resolve the dispute directly, you may contact PrisUm Lab for mediation.
PrisUm Lab hold the right to make final decision regarding the accounts and contents on the platform for both students and instructors.

9. Disclaimer of Warranties:

The Platform is provided "as is" without any warranties, express or implied.
We do not warrant that the Platform will be uninterrupted or error-free.
We do not warrant the accuracy, completeness, or reliability of any content.

10. Refund Policy:

Refunds are available within 45 days of purchase for any accidental payment taken after quitting service or during long break will be refunded fully. Other conditions may apply.

11. Limitation of Liability:

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability to you shall not exceed the amount you paid for the relevant course.

12. Use of Student Data:

We collect and use student data to provide and improve the Platform, personalize your learning experience, and for marketing purposes. We comply with applicable data privacy regulations. More details are available in our Privacy Policy page.

13. Third-Party Tools:

The Platform may integrate with third-party tools (e.g., payment processors, video hosting). Your use of these tools is subject to their respective terms and conditions.

14. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the USA.

15. Force Majeure:

Neither party shall be liable for any failure to perform its obligations under these Terms if such failure is caused by events beyond its reasonable control, including but not limited to natural disasters, war, or acts of government.

16. Severability:

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

17. Assignment:

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations at any time.

18. Changes to These Terms:

We may modify these Terms at any time. We will post the updated Terms on the Platform and notify you of material changes. Your continued use of the Platform after the effective date constitutes your acceptance of the changes.

19. Payment processing:
 We accept various payment methods that would be listed at checkout. All transactions are secured through a trusted third-party payment gateway, ensuring PCI DSS compliance and encrypted processing. Prices are as listed on our site, including applicable taxes. Any additional fees (e.g., tax, fees) will be clearly shown at checkout. An order confirmation email is sent upon successful payment. Recurring payments are billed according to the selected subscription schedule. Refunds are processed as described in our Refund policy. Payment disputes should be directed to our customer support via contact us form. We prioritize payment security. This policy is subject to change and we reserve the rights.
